The Garrett Declaration protects public employees from being compelled to testify against themselves during investigations conducted by their superiors. This declaration, derived from the Fifth Amendment to the U.S. Constitution, states that the government cannot compel any government employee to become a witness against him. Regarding the Garrett Declaration, law enforcement investigators must inform the interviewee of the following before conducting an interview or interrogation: You are being asked to provide information as part of an internal management investigation. This is a voluntary interview, and if your answers could implicate you in a criminal case, you may choose not to answer. Understand that you must answer specifically, directly, and in detail, as this relates to your duty and competence. Refusal to answer may result in punishment and could lead to the end of your career with this agency. You have the right to consult a representative in the form of a senior official and have them accompany you during the interview.
